حدیث نمبر: 1180
حَدَّثَنَا هَنَّادٌ، حَدَّثَنَا جَرِيرٌ، عَنْ مُغِيرَةَ، عَنْ الشَّعْبِيِّ، قَالَ:‏‏‏‏ قَالَتْ فَاطِمَةُ بِنْتُ قَيْسٍ:‏‏‏‏ طَلَّقَنِي زَوْجِي ثَلَاثًا، ‏‏‏‏‏‏عَلَى عَهْدِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ لَا سُكْنَى لَكِ، ‏‏‏‏‏‏وَلَا نَفَقَةَ . قَالَ مُغِيرَةُ:‏‏‏‏ فَذَكَرْتُهُ لِإِبْرَاهِيمَ، ‏‏‏‏‏‏فَقَالَ:‏‏‏‏ قَالَ عُمَرُ:‏‏‏‏ لَا نَدَعُ كِتَابَ اللَّهِ، ‏‏‏‏‏‏وَسُنَّةَ نَبِيِّنَا صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏لِقَوْلِ امْرَأَةٍ لَا نَدْرِي أَحَفِظَتْ أَمْ نَسِيَتْ، ‏‏‏‏‏‏وَكَانَ عُمَرُ يَجْعَلُ لَهَا السُّكْنَى، ‏‏‏‏‏‏وَالنَّفَقَةَ.
جس عورت کو تین طلاقیں دی گئی ہوں اس کانان نفقہ اور گھر شوہر کے ذمہ نہیں
عامر بن شراحیل شعبی کہتے ہیں کہ فاطمہ بنت قیس ؓ کہتی ہیں کہ مجھے میرے شوہر نے نبی اکرم ﷺ کے زمانے میں تین طلاقیں دیں ١ ؎ تو رسول اللہ ﷺ نے فرمایا: تمہیں نہ «سکنی» (رہائش) ملے گا اور نہ «نفقہ» (اخراجات) ۔ مغیرہ کہتے ہیں: پھر میں نے اس کا ذکر ابراہیم نخعی سے کیا، تو انہوں نے کہا کہ عمر ؓ کا کہنا ہے کہ ہم ایک عورت کے کہنے سے اللہ کی کتاب اور رسول اللہ ﷺ کی سنت کو ترک نہیں کرسکتے۔ ہمیں نہیں معلوم کہ اسے یہ بات یاد بھی ہے یا بھول گئی۔
Shahi reported that Sayyidah Fatimah bint Qays (RA) said that her husband divorced her with three pronouncements in the times of the Prophet ﷺ Allah’s Messenger said, “No shelter and no provision for you.” Mughirah said that he mentioned this hadith to Ibrahim who reported that Sayyidina Umar (RA) said, “We cannot give up the Book ul Allah and the sunnah of our Prophet ﷺ for the word of a woman of whom we do not know whether she remembers or has forgotten.” Hence, Sayyidina Umar used to place upon the husband responsibility for shelter and provision during the iddah of the divorced woman. Sha’hi narrated I visited Fatimah bint Qays and asked her about the judgement of Allah’s Messenger ﷺ in her case. She said, “My husband divorced me the divorce al-battah. So I wrangled with him for shelter and provision, but the Prophet ﷺ did not get me these thing.” In the hadith of Dawud, she is also quoted as saying, “He commanded me to pass my iddah at the house of Ibn Umm Maktum.” [Ahmed 27415, Muslim 1480.
